Chairperson Travis called meeting to order at 9:00 a.m. He stated that there being no additions or corrections to the regular meeting minutes of June 1, 2005 they stand approved as printed and distributed.

2006 BCATS Local Funding
WHEREAS , the urban transportation planning regulations, implementing sections of the Transportation Equity Act for the 21 st Century (TEA-21) require that each urbanized area, as a condition of receipt of Federal capital or operating assistance, have a continuing, cooperative and comprehensive (3-C) transportation planning process that results in plans and programs consistent with the comprehensively planned development of the urbanized area; and
WHEREAS , in the Battle Creek urbanized area, the continuing, cooperative and comprehensive transportation planning process is being conducted by the Battle Creek Area Transportation Study (BCATS) Policy Committee, a forum for cooperative transportation decision-making by principal elected officials of local government, developed under federal guidelines for purposes of 3-C transportation planning conduct; and
WHEREAS , the Battle Creek Area Transportation Study annually develops a Unified Work Program identifying activities and costs necessary for the conduct of the 3-C transportation planning process; and
WHEREAS , transportation planning funds, indirectly available from the U.S. Department of Transportation, are utilized to carry out the activities defined in the Unified Work Program; and
WHEREAS , these funds, available under TEA-21 as Section 112 from the Federal Highway Administration and Section 5303 from the Federal Transit Administration Act require a local match of 18.15% and 20% respectively; and
WHEREAS , the Policy Committee of the Battle Creek Area Transportation Study has recommended that the local match required assuring the timely conduct of the Study be determined and provided for in the following manner:
The 81.85%/80% reimbursement schedule will be used for participating agencies (those doing BCATS work will be paid 81.85%/80% of their total charge, with the local agencies picking up the 18.15%/20%). BCATS staff costs will be reimbursed 100%.
The formula for computing the local funds will be based solely on population.
Distribution for local match funding is shown on the attached table.
WHEREAS , it has been determined that the local share requirements for the operation of the Battle Creek Area Transportation Study for 2006 will be $39,851;
NOW, THEREFORE BE IT RESOLVED , the local match share for the Calhoun County Road Commission for FY 2006 will be $14,585; and
BE IT FURTHER RESOLVED , the Calhoun County Road Commission agrees to submit to the Battle Creek Area Transportation Study office (601 Avenue A, Springfield MI 49015 RE: Fund No. 2321) payment of local match share no later than January 1, 2006; or the Calhoun County Road Commission shall have the option of making the payment in two (2) equal installments by January 1, 2006 and April 1, 2006, respectively; and
BE IT FURTHER RESOLVED , the Calhoun County Road Commission agrees this resolution becomes effective at such time as all other local Study participants providing financial support pass resolution of financial commitment in the proportion and manner described in this resolution.

Commissioner Monaweck asked for how it was determined to sell these properties. Mrs. Tabiadon explained that in 2003 the Board decided to sell excess gravel pit properties. Several reality companies presented their options to the Board and after trying different ways of marketing, it was determined that public auction was the best. She mentioned the Phase I and Phase II Environmental Studies that have to be completed on these properties, prior to sale. Voice vote: Motion carried.

WHEREAS , in accordance with Policy #88 – Property Sale Policy, dated August 20, 2003, Calhoun County Board of Road Commissioners determined certain excess gravel pit property would be sold; and
WHEREAS , Carole S. Tabiadon, Deputy Managing Director and Clerk to the Board as designated on June 2, 2004 as the authorized signer on behalf of Calhoun County Board of Road Commissioners; and
WHEREAS , Calhoun County Board of Road Commissioners approved selling Althaver Gravel Pit, Burlington Township property through public auction using Re/Max Landmark Realty Company; and
WHEREAS , the public auction of the Althaver Gravel Pit, Burlington Township property will be held on June 23, 2005 in accordance with all agreements; and
NOW, THEREFORE BE IT RESOLVED that the Board of Calhoun County Road Commission approves the sale of the Althaver Gravel Pit, Burlington Township property.

WHEREAS , Carole S. Tabiadon, Deputy Managing Director and Clerk to the Board as designated on June 2, 2004 as the authorized signer on behalf of Calhoun County Board of Road Commissioners; and
WHEREAS , Calhoun County Board of Road Commissioners approved selling McFadden Gravel Pit, Tekonsha Township property through public auction using Re/Max Landmark Realty Company; and
WHEREAS , the public auction of the McFadden Gravel Pit, Tekonsha Township property will be held on June 23, 2005 in accordance with all agreements; and
NOW, THEREFORE BE IT RESOLVED that the Board of Calhoun County Road Commission approves the sale of the McFadden Gravel Pit, Tekonsha Township property.

WHEREAS , the Calhoun County Road Commission is responsible for the maintenance and upkeep of more than 90 bridges on Calhoun County's Primary and Local road system; and
WHEREAS , it is the desire of the Calhoun County Road Commission to upgrade all of the bridges in Calhoun County with serious structural deficiencies as soon as possible, and
WHEREAS , the Calhoun County Road Commission will need Federal Critical Bridge Funds, if deficient bridges are to be upgraded; and
WHEREAS , the Calhoun County Road Commission has identified five (5) projects consisting of seven (7) bridges that are in critical condition and desires to apply for Critical Bridge Funds for their improvement. Among these bridges is the 22 Mile Road Bridge over the St. Joseph River.
WHEREAS , an application for Critical Bridge Funding has been prepared for replacement/rehabilitation of the 22 Mile Road Bridge over the St. Joseph River.
NOW, THEREFORE BE IT RESOLVED , that the Calhoun County Road Commission has reviewed the application and is actively seeking funding for needed work and so supports the use of Critical Bridge Funds for the replacement/rehabilitation of the 22 Mile Road Bridge over the St. Joseph River in Calhoun County.

WHEREAS , the Calhoun County Road Commission will need Federal Critical Bridge Funds, if deficient bridges are to be upgraded; and
WHEREAS , the Calhoun County Road Commission has identified five (5) projects consisting of seven (7) bridges that are in critical condition and desires to apply for Critical Bridge Funds for their improvement. Among the projects are the three Scour Critical Bridges consisting of the J Drive North Bridge over the North Branch of Rice Creek, the 21 Mile Road Bridge over Rice Creek and the 24 Mile Road Bridge over the North Branch of Rice Creek.

Mrs. Johnson provided the Board with the following information:
Mr. Randolph is in California this week
The paving has been completed on Bellevue Road; started on Wattles Road
The H Drive South Phase II project has started
The brining of gravel roads will be done this week; crews are patching, mowing, sweeping intersections, shoulder clean up, tree clean up and spraying around guard rail and deer delineators.
The River Road project with City of Battle Creek has started. They are working on the sewer portion, which we are not involved in.
The Battle Creek Enquirer and News will spend Friday with the paving crew and will run a story on it June 25 th .
She followed up with the Fairgrounds and advised them that public roads could not be closed for Fairgrounds events.
June 18 th is the Solid Waste Electronics and Computer Recycling event
The County Master Plan was adopted on Monday by the County Planning Commission; copies will be distributed to local units of government.
The Willow Run Road correspondence will be forwarded to the township supervisor for their follow up.
Commissioner Monaweck stated that he noticed farmers planting up to the end of roads. He took some pictures and would like to see it addressed. Mrs. Johnson said that Erin Cummings, Permit Agent, would follow up on it.
Tom Frank, Albion Township Supervisor, said the Auctioneers have a good website. He asked why all primary road work was cut from the list. Mrs. Johnson said we are concentrating on match funds roads. Mr. Frank stated that Mr. Randolph criticizes the prior road commission for not keeping up the roads; now we are doing the same thing. Mrs. Johnson explained it is a matter of balancing dollars and you have to look at the overall picture of what has been done on the roads over the years, not just this year.
Robert Brownell, Marengo Township Supervisor, said that Mr. Randolph stated primary roads would be resurfaced every 7-8 years; some have been longer than that. He said that 22 ½ Mile Road north of I-94 washes out every time it rains, something should be done.
Arthur Robinson, Newton Township resident, said his road was done in 1993-1994 and it was accepted as a public road by the Road Commission. It has been breaking up bad every since. It was patched in 2003 and is breaking up again. He was told it would be resurfaced in 2004, but it never happened. Mrs. Johnson explained her research to date and that she was referring his request to the Newton Township Supervisor for further action.
John Nieterer, Leroy Township Supervisor, gave a list of several roads he would like to have looked at.
Joseph Bramble, Convis Township resident, said that Mr. Randolph promised 16 ½ Mile Road would be done this year; he went back and told his Township Board. Now he notices it has been cut from the roadwork list. The township will not be pleased and it makes him look bad.
Creighton Burrows, Marengo Township resident, asked if B Drive North between Marshall and Albion was a primary or local road (it is local). He heard it was going to have a bike trail on it. He asked who was putting up the bike trail signs. He said that there are no speed limit signs or no passing signs and thinks it is a dangerous road for bike traffic. Mrs. Johnson said she would have Annette Chapman, Calhoun County Parks and Recreation Director, attend the next meeting and explain the project.
Gardy Berezonsky, Marengo Township resident, said one of the bike trail signs is in his yard and he doesn't see why he has to mow around it or give space to a sign in his yard. He can't find where it states that the Road Commission has the right to erect signs in yards.
The next regular meeting is scheduled for Wednesday, July 6, 2005 at 9:00 a.m. There being no additional business before the Board, Chairperson Travis adjourned the meeting at 9:50 a.m. |
