Chairperson Travis called the meeting to order at 9:00 a.m. He stated that there being no additions or corrections to the regular meeting minutes of September 21, 2005 they stand approved as printed and distributed.

•  Received a letter from the Marshall Township Fire Chief, Mr. Steve Riggs, stating due to budget constraints and lack of reimbursement from the CCRC the Fire Department will no longer respond to trees down in the roadway.

•  Received an email response to the 9-26-05 DEQ inspection of the Cold Mix.

•  Received a copy of the Preliminary Injuction from the Calhoun Count Circuit Court regarding the maintaining of the water level on Collier Road in Bedford Township.

•  Received a draft land contract agreement from the City of Albion for our Albion facility.

County roads under the jurisdiction of the Calhoun County Road Commission; and

WHEREAS , under the authority granted in accordance with Section 257.75/257.726 of the Vehicle Code of the State of Michigan, the Calhoun County Road Commission can prohibit or otherwise limit commercial truck traffic; and

WHEREAS , townships noted above have indicated the need for restrictions of commercial truck traffic due to the nature of the roadway and the type of land use along above roads. The Calhoun County Road Commission has reviewed conditions along above roads and concurs with each township noted above.

NOW THEREFORE BE IT RESOLVED : that the Calhoun County Road Commission designates: the above roads, Calhoun County Michigan to be restricted as "No Thru Trucks over 10,000 pounds" .

BE IT FURTHER RESOLVED, to rescind all prior Traffic Control Orders regulating these instructions.

BE IT FURTHER RESOLVED, that signs will be erected to give notice of the regulation hereinbefore established; and

BE IT FURTHER RESOLVED, that certified copy hereof be filed with the County Clerk of the County of Calhoun, Michigan.

RESOLUTION

CALHOUN COUNTY ROAD COMMISSION

2005-20

WHEREAS, The Calhoun County Road Commission fully supports economic development efforts that benefit the citizens and businesses of Calhoun County, and

WHEREAS, The Calhoun County Road Commission and Calhoun County Community Development fully supports the farmland preservation efforts for Calhoun County, and the development and support of infrastructure that benefits and supports the farming community, and

WHEREAS, The Anderson's Company has committed to construct an ethanol processing facility in Calhoun County's Sheridan Township, on B Drive North near the intersection of Michigan Avenue, and

WHEREAS, that the intersection of Michigan Avenue and B Drive North requires upgrading so that it can safely handle additional truck traffic that will be generated by the new ethanol processing facility, and

FURTHERMORE, that the Michigan Department of Transportation is making application for Economic Development Funds (Type A) to construct the required improvement, and that a minimum of 20 percent cash match is required as part of the grant application; and no other entity has stepped forward to assist in the matching of this grant with a cash match.

NOW THERFORE BE IT RESOLVED THAT, the Calhoun County Road Commission agrees to provide a maximum of $31,671.71 as a cash match for the construction of improvements to the intersection of Michigan Avenue and B Drive North. This match is made with the understanding that:

  • This amount is based upon an estimate dated September 7, 2005 and prepared by the Michigan Department of Transportation, which shows a base cost of $137,703.10, plus a contingency of $20,655.47, for a total of $158,358.57.
  • All preliminary, design, and construction engineering costs will be borne 100 percent by the Michigan Department of Transportation.
  • That any additional construction costs above $158,358.57 will be borne entirely by the Michigan Department of Transportation, and that the Calhoun County Road Commission will contribute a maximum of $31,671.71.

AND IT IS RESOLVED FURTHER THAT, the Michigan Department of Transportation has permission to construct this project in Calhoun County Road Commission right-of-way, subject to the following:

  • The Michigan Department completes a permit application for the proposed work and submits it along with the applicable fee, and three copies of the construction drawings, at least 30 days before construction is to start.

Moved by Commissioner Veramay and supported by Commissioner Monaweck to approve Joanna Johnson as Clerk to the Board, to have the authority to enter into any business, sign any documents, or enter into any agreements that the previous Clerk to the Board had done on behalf of the Board of County Road Commissioners and the Calhoun County Road Commission as authorized by law. Voice vote: Motion carried.

Moved by Commissioner Veramay and supported by Commissioner Monaweck to approve the CRAM changes in the ASMRC Constitution. Voice vote: Motion carried.

Moved by Commissioner Veramay and supported by Commissioner Monaweck to approve the nomination of Orrin Gregg, Lenawee County Road Commission as the Director to serve on the County Road Association Board. (1 year term) Voice vote: Motion carried.

Moved by Commissioner Veramay and supported by Commissioner Monaweck to approve the nomination of Dennis Berkebile, Kalamazoo County Road Commission as Commissioner to serve on the County Road Association Board and Joanna I. Johnson as the staff member to serve on the County Road Association Board. (2 year terms) Voice vote: Motion carried.

Moved by Commissioner Veramay and supported by Commissioner Monaweck to approve the Employment Agreement with Kevin S. Henning as Finance Director. Voice vote: Motion carried.

MANAGING DIRECTORS REPORT

Dennis Randolph, Managing Director provided the Board with the following information:

Response from MDEQ from the investigation the made of our cold mix. They inspected all three of our sites. We have no problem with our cold mix and we have a proper permit I fact, they apologized for the comments they made when they were inspecting it.

The injunction listed in item "p." has to do with the beaver dam in that area and the citizens in that area trying to keep the water level down. We did have another beaver problem on Bellevue Road with the water level coming up over the road. We did have some trappers come in and remove 5 beavers. We have contacted some other trappers that are less costly to help us out. Beaver's, along with deer have been a real problem this year.

Maintenance:

  • We continue to do road repairs, filling potholes and tar and chip. We have had around 3,000 hours spent on patching and tar & chip.
  • Continue vehicle maintenance, doing routine check ups and preparing the truck for the winter season. The fleet in pretty good shape thanks to Robert Volkmer, our Fleet Supervisor.
  • We have enough salt in our bins for 2 storms. We resell salt to some of the cities and school districts to try to help them out.

Construction:

  • Clearing trees and brush on Wattles Road and prepping up the east side. We are also doing the same type of work on24 Mile and Homer Road. We have a joint project with the village to pave the shoulders on that piece of road.
  • Our paving crew has been out on the east side of Albion on M-99 doing some trunkline paving.

Engineering:

  • Our permit agent is off and we have split some of the permit work up.
  • Driveway permit inspections.
  • Continue to work on Custer Road Bridge design.
  • We have had to do a lot of extra coordinating work on Pennfield Road because we received extra grant money for the storm water handling.
  • Discussed road improvements for Anderson's Ethanol Plant with MDOT. This project will be done next year.
  • Hershel Stacy has been out doing roadsoft evaluations on all of the roads in the county. They are graded on a scale from 1 - 10.
  • We have made a map with our Geo system, for the tree's around the county and it is easier for our guys to use.
  • Continue Roadsoft evaluations of all roads in Calhoun County.

This Coming Week:

  • We had the second annual Farm Tour up at the Crandall Farm and had about 150 people showed up.
  • Last Saturday we had the fifth annual Kalamazoo River Cleanup. We are one of the sponsor's for this activity. We had approximately 600 people show up for this activity.
  • Friday, October 28 th is our Annual Road Tour and we hope that we have a good turn out.
  • Spending significant time on truckline maintenance.

Conducting numerous studies for safety around the County. We have crash data from 1995 through 2004, which we have been using to see how things stand around the county. This information helps us to evaluate vehicle crashes and if they have increased or decreased on a particular road. With this information we know whether or not a particular road needs to be changed and how we can change it to make it safer for the motoring public. Whether its changing an intersection or put up signs or signals. Actually, our intersections are very safe and on average they only have about 1 crash a year, which is very good. Our safety numbers all around the county are very good.

I've been talking with Marshall Township regarding signal changes on a couple of intersections on Verona Road.

Funding:

We received our August check from the state and it is about 5% down from August a year ago. Our total revenue for the year is down 10%. I anticipate it to be down about 15% because of the gas prices. This means less money and less work that can be done.

Liability - The Road Commission is the only organization that is legally obligated and accountable for what happens on the roads. We pay insurance for the roads every year and townships don't have to do that.

When a storm goes through the county and we have a lot of trees down, we try to get to them as soon as possible. When trees have electrical lines in them, we do not allow our employees to touch them. We always try to get to them within a reasonable amount of time.

Calhoun County is one of the pilot counties for a school safety initiative that is going around the State. With this we are eligible for some new Federal money and would like to spread it out to Harper Creek School and also to Marshall School.

PRESENTATION ON MEDICARE D

A presentation was given by Tom Kolassa from HUB International and Debra Dickson from Blue Cross/Blue Shield of Michigan regarding the new Medicare D Prescription Drug Benefit. This is an informational session only on Medicare D.

COMMISSIONERS COMMENTS:

Commissioner Monaweck commended the workers that did the patching of the culverts on 5 Mile Road south of F Drive and the one on ½ Mile Road north of K Drive. They did a splendid job and should be recognized for the good work. Their were some workers on 1 ½ Mile Road between S Drive and O Drive south and they did a very good job. I just wanted them to know that people appreciated the work they do.

SUPERVISORS & PUBLIC OFFICIALS TIME:

Mr. Frank wanted to know about what will happen on the east side of the county. Joanna stated that our trucks will remain in the Albion & Battle Creek facilities so the county will be covered just as they always have been. Mr. Frank stated that the tar and chip work looks good. Mr. Frank asked if we had any reports on the bio-diesel. Robert Volkmer stated that it is not conclusive yet because we haven't used it long enough to get accurate figures.

CITIZENS TIME:

Clarence Millard stated that everything in his area was good.

Joseph Bramble stated that he still had some questions on the Medicare D information.

Joanna Johnson welcomed Kevin Henning as our new Finance Director. Kevin thanked the Commissioners for their endorsement and look forward to a long working relationship with the Road Commission.
